CASUAL SHIFT ENGAGEMENT AGREEMENT
(Platform-Facilitated Marketplace Agreement)
1. Parties
This Casual Shift Engagement Agreement (“Agreement”) is entered into directly between:
Together, the “Parties”.
2. Platform Facilitation
This Agreement is facilitated via Shift Filla (“Platform”).
- Is not a party to this Agreement
- Does not employ or engage the Worker
- Acts solely as a technology marketplace and payment facilitator
A legally binding contract is formed directly between the Venue and the Worker upon acceptance via the Platform.
3. Nature of Engagement
3.1 This Agreement relates only to the specific shift(s) described below.
3.2 Each shift constitutes a separate, stand-alone engagement, even where multiple shifts are accepted as part of a multi-day block.
3.3 There is:
- No obligation on the Venue to offer future shifts
- No obligation on the Worker to accept future shifts
- No expectation of continuity, regularity, or ongoing work
3.4 Nothing in this Agreement creates an employment, agency, or partnership relationship.

Where multiple dates are listed, each date represents a separate engagement under this Agreement.
5. Fees & Payment
5.1 The Venue agrees to pay the Worker the agreed gross fee.
5.2 Payment is made gross, with no deductions, via the Platform’s payment system.
5.3 No PAYE, KiwiSaver, holiday pay, sick leave, or other employment entitlements apply.
6. Tax, ACC & KiwiSaver
6.1 The Worker is solely responsible for:
- Income tax
- ACC levies
- KiwiSaver contributions (if any)
- GST obligations (if registered)
6.2 The Venue has no obligation to deduct or contribute amounts on the Worker’s behalf.
7. Worker Independence
7.1 The Worker:
- Chooses whether to accept the shift(s)
- Retains discretion over how the services are performed
- May provide services to other venues or platforms
7.2 The Worker supplies their own skills and judgement and is not subject to supervision, training, or direction beyond venue safety and operational requirements.
8. Venue Obligations
The Venue agrees to:
- Provide a safe working environment
- Pay the agreed gross fee
- Communicate any role-specific requirements relevant to the shift
9. Ratings, Conduct & Platform Rules
9.1 The Platform operates a two-way rating and review system.
9.2 Ratings reflect user experience only and do not constitute performance management.
9.3 Access to the Platform may be suspended or terminated for breaches of Platform Terms, misuse, or trust and safety concerns.
10. Cancellation & No-Shows
10.2 Failure to attend a confirmed shift may result in consequences under Platform Terms, including restricted access.
These consequences are platform governance measures, not employment discipline.
11. Disputes
11.1 Any dispute relating to this Agreement is between the Venue and the Worker.
11.2 The Platform may facilitate communication but does not adjudicate employment or performance matters.
12. Contract Timing & Acceptance
12.1 This Agreement is issued electronically shortly before the scheduled start time (including up to five (5) minutes prior).
12.2 Acceptance occurs when the Worker commences the shift or confirms acceptance within the Platform.
13. Limitation of Liability
Each Party is responsible for their own acts and omissions. The Platform bears no liability arising from the engagement.
14. Governing Law
This Agreement is governed by the laws of New Zealand.
